Have Never Heard of this Action!

The Willow, AK highway job has been somewhat of a night mare sense it started. Tony Green of AKA Plow, Anchorage, received the contract for trucking from QAP (Quality Asphalt Paving). No one wanted to go the Willow to work, but the trucking community is always willing to toss the ROI book right out of the room. ROI is "Return on Investment."

Few truckers understand that subject. In fact for every one that does there are 135 who have never heard of it. General contractors know what it is and live by it. That is one of the biggest reasons the general contractors don't have their own trucks.

The Willow job has issued a huge blow to the ROI of the trucker. It seems the Department of Labor for the State of Alaska has issued an order to stop all payments to truckers and or subcontractors for the job. Wow, the DOL doing something other than sitting on their butts and watching the grass grow! Truckers do not know why. QAP knows why and Tony Green knows why. But the average trucker is just going to operate in normal mode and simply not get paid.

The DOL is acting off a complaint, I would guess. Because the DOL operates under the cloak of secrecy, only QAP, Tony Green and the complainant knows what is going on. It has been my experience the complainant may not know what is going on. As blatantly unfair as the DOL is, the trucking community cannot expect any more from the educated group of "self job protecting" people in the Wage and Hour Division of the Alaska Department of Labor.

It would be my guess that whatever has closed this job down to the flow of funds, understand the work has not stopped, just the money, the reason could be applied to 99 per cent of all jobs in the State of Alaska where DOL W&H has any control!

Inaction is what the Labor Department is counting on.

We are really giving them what they want. If we earth haulers don't pay attention to the pressure being applied to have things change for the better, nothing is going to happen. We need to organize and put money in the association of earth haulers and then put real pressure on the Department of Labor to do things correctly. As I write to politicians I find out that they do not believe anything we say and most do not even want to get involved in our situation.

Hauling dirt is not a reputable business and we must change this thinking. We must invest in our lives. We must changed things we can control. The problem, of course, is the General Contractors will simply put us out of business if we stand up and lead. That is why we need an association that can keep the members secret.

We owe Senator Hollis French and his office

Because Donna Stark and Charlotte Emerson worked together on our benefit we have Senator Hollis French taking interest in our troubles with the Alaska Department of Labor. There have been a number of other Representatives and Senators we went to and were able to receive no interest. Harry Crawford displayed some interest and Johnny Ellis's office expressed a bit of interest. So many others told me they did not know any body in our industry. What difference does that make; if the politician is told we are in trouble and the DOL is abusing us, we should receive assistance! They should have helped by, at least, sending us to another person who could help us.

Because of Senator Hollis, The Commissioner of Labor, Mr. Bishop, decided to direct our most ardent enemy, Grey Mitchell, Director of Standard and Safety, to have a hearing which turned out to be a teleconference which only about 30 contacts called in. That was 30 out of 4,000 Earth Haulers in Alaska. But there was about seven non earth haulers in the conference. Grey Mitchell sent 450 announcements to Alaska Earth Haulers and opened only 100 phone lines for call ins.

Where did the mailing list come from? June 23, 2009 the Security Tax Division under the Alaska DOL mailed a letter about leasing trucks on Public Construction Projects and Grey Mitchell used that list is is my guess.

Charlotte Emerson said it has been 16 years that nothing has been done for the Earth Haulers and I believe it has been 23. Grey Mitchell has been involved in every event for more than 25 years and he is still here abusing the people of Alaska! It bothers me that a man in charge who is educated and knowledgeable about every little detail in the business is fearful of the cost of ligation to adjust a problem that places hundreds of earth haulers in poverty every year. His actions, alone, influenced many General Contractors, truck brokers and truck owner operators to take a path of learning the details of Pamphlet 400 and "CHEAT" as much as possible because they wanted to survive. The AK DOL was not going to enforced any laws in public construction and therefore truckers and their families could not win against such a formidable foe!

8 AAC 30.020 (e) in Pamphlet 400

8 AAC 30.020 (e) If a contractor is under contract to provide trucks on a public construction project and leases a truck to an individual truck driver or dispatches an owner/operator working on that same project, the contractor shall pay no less than the prevailing wage for each hour worked each certified payroll reporting period to that driver.

When trucks work on a public construction project in Alaska the driver even if it is owner operator should be paid at least the hourly wage and benefits every week or two. It is required, but the Alaska Department of labor, Wage and Hour Division has no interest in doing the right thing by enforcing the regulation. WHY? Corruption!

Only one time in the history of Alaska has this rule been followed and the W&H had almost nothing to do with it. Dick Strahl's integrity got that done. The contract was taken away from him soon there after.

8 AAC 30.020 (d) In part - After deducting operating expenses, the actual payment received by an owner/operator performing duties as a laborer, mechanic, or field surveyor must meet or exceed the minimum prevailing rate of pay in the applicable classification for each hour worked on a public construction project.

In Wisconsin and Minnesota the DOL decided it was in everyones interest to establish an operating cost guideline for the dirt truckers of their states. Several other States were to do this. Both States agreed and this is the guideline for operating cost of a truck after 18 months of communications with th industry without a driver. The Department of Labor, Wage and Hour should do something about things.

The numbers are per hour rental for the truck only. A driver may be the owner or the hired driver. Either way the Alaska W&H should use this as a guideline.

July 20th Teleconference

There are those who think we made headway and I say if it were not for Senator Hollis French and a couple of truckers we would not have gotten anything. Sad but true. 20 years and nothing until Mr. French got involved. It is very sad that the Alaska Department of Labor is so very closed minded to the people.

It is a week later and still nothing. No communications by the DOL. No help and I don't believe there will be any. We truckers are slaves to an oppressive system and it will not change any time soon. The people do not matter. The Politicians just are not concerned for us. Maybe Senator French will prove this a untruth and lead the other politicians to getting involved with the people outside of asking for donations.

An Airport job when it is really needed!

We have a job in Anchorage. Dirt Truckers can rest a bit because about 20 trucks are going to be able to go to work. But don't spend your money too fast. You are not going to make much!

Add on top of that is the State of Alaska thought it would take $45,000,000 to do the job and QAP is doing it for $33,000,000. AIC bid $40,000,000 and still lost it. What happens tot he $13,000,000 dollars. We don't get it so the DOT must get it if Alaska Politicians don't steal it. Now lets go to the trucking. Trucking is a good bit of the bill. But the general contractor is going to the bank with all of our profit money. Alaska Pro Truck won the bid for trucking over World Equip. and RL Trucking and Fry's Services and AKA Hauling amoung others. Alaska Pro Truck is going to pay $95 for the truck. Can you operate for $95? I guess you know the fuel prices are going back up. Oh, I know, you can pay your drivers less! If you boycott this job, Zapay can do the job with his trucks that he rents to the drivers by the day to avoid payroll.

Also you can rent your truck to a driver and not worry about Payroll taxes and workers comp insurance.

Yet another trucker does not get paid!

What is it going to take to get dirt truckers to understand they need to get paid for their services? I was fighting very hard for the 4,000 earth haulers in Alaska until JP Freie of Fry's Services decided to sue me and file an APOC complaint that took a lot of my time to defend. He derailed my efforts to help the industry for a year! You lost. What to do?

I receive another note from a friend of JP Freie's who has not been paid by Fry's Services. Big Surprise! Brokers out there not paying truckers are way too many! You truckers are the only ones who can change this action. Stand with me and fight the bad business practice of getting your services and not paying you!

March Law Suit Report

Hello; the 9th of March we return to the courtroom to find out if the judge is going to allow us to dismiss or go to trial. Gee, it is hard to understand the mine of JP Freie or for that matter Attorney Charles E Tulin. Tulin wants to get rid of this case and his client will not keep his mouth closed in court. More of a wonder, Judge McKay keeps listening to the Plaintiff above the Attorney for the Plaintiff and the Defendant.

Repeated request for the information John P Freie is upset about continues to be kept secret. What is he upset about? The truth! There are few trucking firms in the State of Alaska who want their laundry to be viewed by anyone outside their company. Why?, because we all have done wrong! There is fear in everyone because The Department of Labor and The Department of Transportation in Alaska has lead us to the situation where we do as they direct and breaking the rules is the standard! The Wage and Hour Department of Alaska is the worst in breaking the rules by not enforcing them. Their leadership is from Grey Mitchell and Sandy Cannon. The Commissioner of Labor is simply allowing things to happen because he has no idea of what is going on. His position is "no-knowledge." Grey Mitchell has been there under two different Commissioners. Does anyone think the Commissioner has any idea what is going on in our world?

There is a rumbling going on in the State of Alaska and there will be several trucking firms hit. A General Contractor is being investigated and those who worked for them are being investigated also. Will they find anything? Who knows. Little can be found if they do not know what to look for. Criminals don't make things easy to find for the investigators.

December to February Law Suit Report

Hello fellow earth haulers,

This is the latest on the law suit of Freie against Baldwin. The 13th of January we sat down in the court room and JP Freie had agreed with his attorney Mr. Charles E. Tulin to accept the idea of doing his W2's and 1099's more appropriately. Wow, at the last minute Judge McKay turned to Mr. Freie and asked if he agreed to all of the preceding and Mr. Freie decided not to keep his word as his attorney guided him and said to the judge, “I want Mr. Baldwin to take down all of the untrue statements on his web sites!”

Because Mr. Freie has made this statement we wasted the last 15 minutes. Now the Judge has extended the trial plans into March and who knows how long the trial will be put off now. Mr. Tulin asked John P Freie if he could come up with a list of false statements so Mr. Baldwin could provide any evidence to prove them true.

It is February 4, 2010 and we do not have the list as of today. That is three weeks and there is not a list of false statements as yet. I never want to make a false statement on my web site. If there is one I encourage any and all to provide guidance to me so I can straighten any miss-statement out. But earth haulers don’t like to talk. In the words of the honorable Judge McKay to Mr. Freie “False Statements are actionable.”

This case was filed in May 2009 and we are still putting off the trial.

Best example in the world short of a Death!

Tony Green and his Company, AKA Plow, is hauling snow in the City of Anchorage for $52 dollars per hour. Dirt brings $95 dollars per hour even in the winter! This snow deal with the City and the State is nuts and it has been for years.

These owner operators are clambering to work and they are willing to give up $43 per hour to be able to haul snow for the City of Anchorage contract. At $52 per hour there is little money to deal with by the owner. If the owner has a driver, the driver must be paid. That is $15 per hour leaving $37 for profit and Insurance and Fuel and Maintenance and payroll cost. Do you think the owner operator has workers compensation?

Did this driver and owner of the truck have workers compensation? The answer is, "no" they did not. The driver would not go with the ambulance because he knew he had no workers comp. insurance. He also had no health insurance.

When is this madness going to stop?

Third Day of Law Suit Reporting

Today is the 30^th of December and I am studying the lay out of how I will proceed in the court room. Gee, I am again realizing that it is hard to plan a defense when the Plaintiff has not provided a good reason for the law suit in the first place. To be honest, J. P. Freie is simply angry that someone has stood up to him and tried to not allow his abuse to the industry.

Freie of Fry’s Services received about 35 percent of the business for dirt trucking in 2009 around Anchorage. All I heard was he can’t make any money at those rates. Well, if you consider the way he got his trucks and the way he maintains them and the drivers he picks he can do business for less and he just accepts a lower rate of return on his investment. When I worked with him all I heard was I bid it too low and you guys need to do a good job and keep things tight.

What this really means is he was going to be slow in payments. I often wondered why he bid so low if he knew what he was doing. The condition of the trucks suggested often he did not know what he was doing.

Second Day of Law Suit Reporting

Today is the 29^th of December and I received the Jury instruction guidelines as the judge told me. These guidelines are very interesting to read. They get into the law as it applies to this case. I must read them and study in my preparation for the trial.

As far as I am aware there has never been a law suit in the earth hauling world of a broker suing a trucker for what appears to be assignation of character. Then there has been very few people stand up to brokers. We all talk about these trucking brokers and almost none of us believe they are good for the business. However, there are a few truck brokers that the industry members tell me regularly that need to go away. They are bad for the industry because they will not charge a decent rate in an effort to get the contract from the general contractor and hope to benefit from volume. This effort is always at the cost of the trucking community. Lower rates do not support the cost of operations. Thus we have too many unsafe trucks on the roads in Alaska.

First Day of Law Suit Reporting

Today is the 28^th of December and we have a court date today with the Honorable PATRICK J. McKAY.

Wow, the court experience today was much better than I anticipated. First, J.P. Freie did not show up. He was out of town. The court date was not important to him, it seems. He sues me and does not even show up for court.

Guess what, his attorney did not show up either. What is this? There is a court date and neither of the participants shows up. The attorney Charles E. Tulin had his secretary call in to the court and act on his account. This was ok with the judge also.

Anyway, Freie wanted his attorney, Tulin, to change his May 2009 request for a jury trial to a court trial whereas the judge will decide. I disagreed and Judge McKay agreed with me. We will have 12 jurors listen to the trial and they will decide. I win this round. Thank you Judge McKay.

The next court date is 13 January and we will see who shows up. The trial is to be around the 27^th of January and maybe will be moved to the first week in February.

Is the DOT harassing all Commercial Drivers in Alaska?

There seems to be too many drivers who are getting odd non-tickets from the Department of Transportation officers under compromising situations. Because there is fear in the area of retaliation from the DOT, few drivers are willing to discuss it. I am not able to get copies of any reports or statements of points/penalties under the Prism system. Do you want to be abused by the DOT or any other agency operation that affects you and your ability to drive and make a living?

Oil Pricing Per Barrel Has a Serious Affect On Your Future!

Oil is at $73.22 today 10-12-09 and you Alaskan Earth Haulers are doing nothing to protect yourself. This suggest strongly that you are willing to allow the General Contractors of Alaska and even some in the lower 48 to control your hauling business.

We are going to get hit again by higher oil prices and your profit margin is going to go down! Do you follow your profit margin? It is not only the difference in what you pay for fuel and the truck rate you receive from the broker sub-contractor! That is only one aspect of the equation! Each trucking operation has a different approach to their profit margin equation.

Those who have an extra business or income source should not use that income against the profit margin for trucking. Look at the real profit margin of the trucking operation and not an overall view of your income. Please keep your other income out of the discussion on trucks.

Oil is going to get More Expensive

Russia is now the leading producer of oil in the world. The discussions are suggesting the cost of a barrel of oil will go to $175.00! What is that going to do to your cost of operations?

You truckers have not wanted to address the cost of operation for years now. If you don’t get organized soon you will face a horrible situation where you might not be able to afford to operate your truck. Why let the general contractors win this battle? They don’t have trucks because they can’t afford them or don’t want to spend the money when they have you guys!

Remember a few years back when the cost of fuel started up and we sat back and kept accepting the added cost instead of being organized so the increased could even be anticipated and charged properly. Don’t let the cheap guys in the business scare you! Whole your position and get more money for your truck. There are even new company’s in our industry that came from the housing industry to take our business with their trucks. They will even be going up in price at the on slot of higher fuel prices.

Wait until the snow comes and it will be too late to adjust without losing money. It is time we stopped losing money!

We are Going Down Hill.

Has anyone asked why JP Freie of Fry’s Services would be so concerned about Del Baldwin Lobbying for the benefit of the Earth Hauling Industry? We must ask JP why he is so upset at the idea of having a level playing field. The rules and regulations in Wage and Hour and Employment Security Tax are not enforced and that hurts us all.
He is a bit upset at my advertising his not paying Ivan Wilkinson for eight months and the fact that he has not paid me for a year now. Then there is the fact that he abused the relationship with Rick Quattlbuam. And we still have the bad relationship with William Schyuler. Last, but not least, you have Tommy Thomas. Let us not forget the parking situation on E82nd Ave where he abused his neighbors so badly.

JP Freie has been against everything I have tried to do for the last 14 months. Clean up the industry. He told me 14 months ago I could do what ever I wanted to help the industry as long as it did not hurt him.

JP got a good deal of the business in 2009; big contracts that several of the larger brokering subcontractors wanted. Of course, JP would not have succeeded if Alaska Pro Truck, Dan Zipay, would have accepted the change in terms of the contracts by Granite Construction. Is that not something? Granite issued a bid and after it was won changed the details and JP was willing to accept the changes while Alaska Pro was not.

The other big one in 2009 was North Star Trucking on the 48th Street job by AIC. They took it from RL Trucking and dropped the price to as low as $79.00/hr. The rules of Wage and Hour and Employment Security Tax are not enforced.

The regular truck brokering subcontractors are hurting this year because they wanted to do things correctly and got shot in the foot. The single rule of 8AAC 30.020 (d)(e) being enforced would put the shoestring operations of Fry’s Services and AKA Plow out of business. The rule is a very good rule and put into Pamphlet 400 for a reason. It should be enforced! Tony Green told the group at Wage and Hour offices he could not stay in business if that rule was enforced. Therefore, Wage and Hour has decided it is better to not enforce the rule so Tony Green can stay in business and that hurts the rest of the industry.

Final results of the APOC Commission Complaint 09-03-LOB

I went today for the final decision of the Commission. September 24th, 2009. Some time ago John P. Freie showed his fear of my activities in filing a complaint at APOC which is the Alaska Public Office Commission. This is a serious situation as I have found out. They investigate vigorously.

I was found innocent and this gives me a guideline for the future. For one thing, I cannot be a lobbyist for the earth hauling industry. It requires a company to employee me and provide the funds necessary to support such an endeavor. This is the law. The cost is too high for the earth hauling industry companies.

The Earth Hauling Industry is not set up for this level of pro-active benefit to the industry. Gee, it seems odd that one man is so afraid of my activities that he will file an APOC complaint to slow me down and because he did not see that as good enough he filed a law suit. The law suit is no different than the APCO action. It is frivolous. Freie sees my activities as threatening to his actions of wrong doings and his law suit is the result of his thinking.

He once warned me not to do anything against him. I was welcome to try and change the rest of the industry but I had better not go after him. Guess what, I am going after him because he is the one I know most about.

I am publishing the findings and recommendations of the APOC Commission that was accepted and approved by the Commission this morning and you can read the situation.

Current Situation in the Regulatory World in Alaska

We have a group of top trucking subcontractors in our industry who have been hurt in 2008 and 2009 trying to do things the correct way and the little powers that want to be are taking advantage and getting ahead by getting the jobs and not following the regulations and the regulatory agency’s are allowing it. This is simply wrong!

The areas of contention are:

1st

the Unemployment Security Division

2nd

Wage and Hour:

Certified Payroll, who fills them out

List of who is on the job

Details of how to fill out a payroll

False Payroll

Non Payments of wages

Understanding of what is DB and what is not DB

Lack of knowledge of projects

Repeat yearly offense’s by same and new contractors.

Lack of training on the parts of investigators

Lack of transparency with the industries they oversee

Almost no enforcement of regulation

3rd

the general contractor and trucking brokers are taking advantage of the trucker

4th

the truckers are not getting paid in good time

Waiting to pay trucker until the broker gets paid is WRONG!

5th

the trucker not being given written instructions of what times to keep for proper DB times

Misunderstandings by general contractors and truck brokers who instruct drivers inappropriately.

A Question of Why Change

It is my thought that change from doing things badly and against the rules is a good thing. It is positive to stop the abuse in the Earth Hauling Industry. If you are not aware of the abuse, you are not paying attention to the drivers in the industry. You do not receive the phone calls from 25 year veterans of hauling earth products hoping there is a new person to help them.

Naming a large number of drivers who have been abused is not necessary here. But to shorten the wonderings, I have been abused because my company did not get paid properly by many brokers. My company not getting paid in good time is the reason we are out of business. It is the reason my girlfriend is cleaning buses instead of driving trucks.

Change the wrong doings to correct actions is my drive. People will get hurt in this action because the State Agencies will not do their job correctly. They have not done their job correctly for us for 25 years. They have left us out to dry for 25 years. We (the Earth Hauling Industry) have accepted the situation for 25 years as not being able to do anything about it.

We need to do things right for the better. Unemployment Security Tax Division needs to see things are done correctly and collect taxes from the general contractors if owner operators are not paying them. Companies need to pay unemployment payroll taxes and not avoid them. There is more effort put into avoiding payroll taxes than simply following the rules.

Wage and Hour Division needs to enforce Pamphlet 400 8AAC 30.020(d)(e). This single rule being enforced would change the world of Earth Hauling for the good of the driver. It would drive the bad businesses out of business. Therefore, they could not abuse any longer under the rule.

Mini Davis Bacon was devised because someone studied the rules and figured out how to beat the system at the expense of the drivers. Is it breaking the law, No! Is it abusing the driver, yes! Why do it then? The broker wins the bid at a lower price and no body is the wiser. The general contractor gets to keep more profit designed to go to the drivers and no one cares. The Wage and Hour Division did not even know Mini Davis Bacon exist.

Millions and millions of dollars are moving though the hands of general contractors and brokers; drivers are not getting their fair share. This is the reason we need to change the current wrong doings.

Court Ordered meeting with JP Freie, Fry's Services

This video was a meeting with JP Freie and his attorney, as ordered by the court. It was three weeks late due to attorney not following the orders of the court.

I wonder why the courts orders were not important enough to be followed by the attorney. Gee, the meeting did not even follow the intent of the order to discuss resolution of the differences. I tried to get the attorney and JP to go over the items and they choose not to.

Unfortunately, the camera fell down in my pocket and the video cannot be seen. However, the sound is all that is needed here. The only thing missing is JP reactions to various comments. I believe JP to be a dangerous man.

Follow up on Abuse

I have finally gotten some attention from a higher authority outside the State of Alaska. If you earth haulers did not realize it, the State of Alaska is being watched and higher powers are wondering what is going on with the billions of dollars coming into our State under the idea of construction. Get on the right side and get your paperwork in good order. Those guys taking advantage of you earth haulers may be in store for their time.

Abuse is rampant and it is not at the surface. An investigator must be able to get under the niceness of the contractor and the trucking brokering subcontractors to find the shenanigans. It has not been too hard to stay under the radar of the Department of Labor since they have no radar. The Department will just send their INVESTIGATORS out into the field and the drivers will simply lie to them because they will do nothing to help. They do not follow the rules set down by their very own Department. I believe the investigators want to do what is right but can’t because the powers that be are so corrupt they will lose their jobs if they do it right.

Update on the law suit.

We had a meeting between John P Freie and Sue and the attorney and me. It was interesting. At first JP tells us he has nothing to say and then he burst out with all these foul mouth words that have no place in a public building. I suppose he will contain himself in court. It is a sign of his character, I would think.

The meeting was a court ordered meeting to try and settle the situation out of court. JP does not think that is possible. You guys working for him know how he is when he displays no respect for you. You are not as good at the mud he has on his shoe.

As is the rule only the attorney wins.

I am reporting here so the general earth hauling world can see what a suit is all about.
